Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and NestIT Ltd ("NestIT", "we", "us"), a company registered in England & Wales. They govern your use of the Penna mobile application and the website at handwritehq.com (together, the "Service").

By creating an account or using the Service, you confirm you have accepted these Terms.

1. Eligibility

You must be at least 13 years old to use Penna. In jurisdictions where the digital-consent age is higher (e.g. 16 in some EU member states), you must meet that age. The Service is not designed for children under 13.

2. Your account

You sign in with a Google account via Firebase Authentication. You are responsible for keeping your sign-in credentials safe.

You can delete your account at any time:

We may suspend or terminate your account if you breach these Terms.

3. The Service

Penna analyses photos of your handwriting using third-party AI models (Anthropic Claude and Google Gemini) and returns a legibility score, sub-scores, written feedback, a practice drill, and an annotated image overlay.

The analysis is automated guidance, not professional advice. Penna grades everyday legibility only — not calligraphy, graphology, or character traits.

4. Acceptable use

You agree not to:

  • upload photos of someone else's handwriting without their permission;
  • upload anything illegal, harmful, or infringing;
  • attempt to reverse-engineer, scrape, or abuse the Service;
  • attempt to evade usage limits or paywalls.

5. Subscriptions, free trial, and billing

Penna offers a Free tier and a Pro subscription. Full details, including the feature comparison, are at /pricing.

  • Free trial. New users may receive a 7-day free Pro trial. It converts automatically unless cancelled before it ends.
  • Auto-renewal. Subscriptions renew automatically unless turned off at least 24 hours before the end of the current period.
  • Cancellation. iOS: Settings → Apple ID → Subscriptions. Android: Google Play → Subscriptions. Cancellation takes effect at period end.
  • Refunds. Handled by Apple App Store and Google Play. NestIT does not process refunds.
  • Price changes. We give at least 14 days' notice of price changes.

6. Your content

You retain all rights in your photos. You grant NestIT a limited, worldwide, royalty-free licence to process, store and transmit your photos solely to provide the Service to you. This licence ends when you delete the analysis or account.

We do not use your photos to train AI models.

7. Our intellectual property

We grant you a personal, non-transferable, revocable licence to use the App and Website for personal, non-commercial purposes. You may not copy, modify, or redistribute any part of the Service except as permitted by law.

8. Service availability

We aim for high availability but do not guarantee uninterrupted access. Parts of the Service depend on third-party providers (Apple, Google, Firebase, Anthropic, RevenueCat).

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranty. Nothing in these Terms excludes liability that cannot be limited by law (including liability for death or personal injury caused by negligence, or fraud).

10. Limitation of liability

Our total aggregate liability in any 12-month period is limited to the greater of (a) fees you paid us in that period, or (b) GBP 50. We are not liable for indirect, incidental, or consequential damages.

11. Indemnity

You agree to indemnify NestIT against claims arising from your use of the Service in breach of these Terms or from your content infringing third-party rights.

12. Changes to these Terms

We may update these Terms. For material changes, we give at least 14 days' notice via the App or by email. Continuing to use the Service means you accept the updated Terms.

13. Termination

You may stop using the Service at any time. We may terminate access immediately for breach of these Terms. On termination, §§ 7, 9, 10, 14 survive.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that EU consumers may also bring proceedings in their country of residence under mandatory local law. EU online dispute resolution: ec.europa.eu/consumers/odr.

15. Apple App Store — additional terms

If you obtained Penna from the Apple App Store, you acknowledge that:

  • These Terms are between you and NestIT Ltd, not Apple. Apple has no responsibility for the App.
  • Apple has no obligation to provide maintenance or support for the App.
  • NestIT — not Apple — is responsible for warranty failures, product liability, compliance claims, and IP infringement claims relating to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
  • You confirm you are not in a US-embargoed country or on any US prohibited-persons list.
